Enduring Power of Attorney & Care Representation.

An Enduring Power of Attorney (EPA) is a proactive arrangement designed for individuals anticipating potential incapacity in the future. It allows a person (the Donor) to appoint another individual or individuals (the Attorney) to manage their personal welfare, property, and financial affairs should they become mentally incapacitated.

The EPA can grant broad authority to the Attorney, empowering them to make decisions on all aspects of the Donor's affairs, or it can be customized to delegate authority over specific matters. It is important to note that the EPA only becomes effective upon registration with the Decision Support Service, following medical certification of the Donor's incapacity.

This allows them to manage financial and healthcare decisions on behalf of their loved one.

* To appoint a Care Representative, an application must be made to the Courts with 2 medical reports detailing the individual's condition. Written notification to family members or their consent may also be required.

Assisted Decision Making (Capacity) Act.

In the event that a person has not created an Enduring Power of Attorney and becomes unable to manage their own affairs, our solicitors can offer expert guidance and representation for clients and concerned relatives.

We assist in obtaining a Decision-Making Representation Order (formerly known as Ward of Court.) This court order allows the appointment of a representative to make decisions on behalf of individuals who lack mental capacity to do so themselves. Importantly, the appointed representative is obliged to respect the wishes of the person they represent.
